The Supreme Court of Montenegro has delayed sending Do Kwon,, back to South Korea. Judge Seka Piletić made this decision after the Supreme State Prosecutor’s Office (VDT) asked for more time to review the case. 

The delay allowed the VDT to check if the decision to send Kwon to South Korea, and not the United States, was legal. The VDT stepped in right after the Court of Appeal supported the High Court’s decision to extradite Kwon to South Korea, stopping the police and the Ministry of Justice from acting immediately.

Do Kwon’s lawyer, Goran Radić expects that Kwon will be sent to South Korea once the final decision is made. He pointed out many legal inconsistencies in Kwon’s case, noting that the prosecution did not object when the High Court initially decided to extradite Kwon to the US, even though later decisions were different.

Kwon faces accusations of fraud worth at least $40 billion in South Korea and the US related to the collapse of his cryptocurrencies, Luna and Terra. He has been waiting for extradition for months at the Aliens Shelter in Spuz after being arrested using fake passports in March 2023 at Podgorica airport with his business partner, Chang Yun.

Uncertainty Remains as Supreme Court Delays Extradition Decision

Montenegrin courts have ruled multiple times on whether to send Kwon to the US or South Korea, making his case unusual due to the seven different decisions. Initially, the High Court decided to extradite him to the US, but after reversing that decision, it ruled to extradite him to South Korea. This case has also sparked political disputes between former and current Prime Ministers Dritan Abazović and Milojko Spajić.

The Supreme Court’s decision to delay Kwon’s extradition adds more uncertainty to the case. With the Supreme State Prosecutor’s Office now involved, the outcome is still unclear, reflecting the ongoing legal and political challenges surrounding Kwon’s situation.
